The paper deals with the classification of Bitcoin in terms of monetary theory, its role in international currency competition, European regulation (MiCA), tax issues and possible fields of application in energy and technology policy. <\/p>\n<p>The Bitcoin Bundesverband does not evaluate the content of this motion. However, we welcome the fact that <strong>Bitcoin<\/strong> is being discussed <strong>as an independent topic<\/strong> in the German Bundestag and has been placed on the agenda for the 21st parliamentary term. We will follow how other parliamentary groups and members of parliament react to the proposed points and which aspects are included in future debates and legislative procedures.  <\/p>\n<\/div>\n[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]\n<h2><strong>Abstract<\/strong><\/h2>\n[\/vc_column_text][vc_column_text css=&#8221;.vc_custom_1764924863711{margin-left: 50px !important;}&#8221;]\n<ul>\n<li>A motion has been tabled in the German Bundestag that emphasizes the <strong>strategic potential of Bitcoin<\/strong> and warns against overregulation.<\/li>\n<li>The core topics are: <strong>Differentiation of Bitcoin from other crypto-assets<\/strong>, implementation of MiCA, tax clarity as well as energy and location issues.<\/li>\n<li>From the perspective of the Bitcoin Bundesverband, it is positive that Bitcoin is being seriously discussed as an independent technology and that topics such as <strong>innovation protection, legal security and energy integration<\/strong> are being addressed.<\/li>\n<li>At the same time, we see <strong>a need for optimization<\/strong> in the differentiation of the arguments, particularly with regard to energy, regulation and international classification.<\/li>\n<li>We welcome the debate in the Bundestag and are available to <strong>all democratic players as an expert point of contact<\/strong> in order to advance the content of the discourse.<\/li>\n<\/ul>\n[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]\n<h2><strong>1. background and content of the application<\/strong><\/h2>\n<p>On October 17, 2025, the German Bundestag was presented with a motion in printed matter 21\/2301 entitled<br \/>\n<strong>&#8220;Recognizing the strategic potential of Bitcoin &#8211; preserving freedom through restraint in taxation and regulation&#8221;<\/strong>.<\/p>\n<p>The application:[\/vc_column_text][vc_column_text css=&#8221;.vc_custom_1764924839843{margin-left: 50px !important;}&#8221;]\n<ul>\n<li>describes Bitcoin as a <strong>decentralized, scarce, digital money<\/strong> that is clearly different from other crypto-assets,<\/li>\n<li>criticizes possible <strong>overregulation<\/strong> in the course of implementing the MiCA Regulation,<\/li>\n<li>calls for <strong>tax clarity<\/strong> for privately held Bitcoin,<\/li>\n<li>emphasizes the potential contributions of Bitcoin mining to <strong>energy and location issues<\/strong>,<\/li>\n<li>and demands a <strong>strategic statement from the German government<\/strong> on the role of Bitcoin.<\/li>\n<\/ul>\n[\/vc_column_text][vc_column_text css=&#8221;&#8221;]The Bitcoin Bundesverband does not assess the motion in terms of party politics, but rather classifies the content against the background of its mission and positions.<\/p>\n<p>We welcome the fact that Bitcoin is being discussed in the Bundestag on a substantive level and will observe which aspects are adopted by other parliamentary groups in future debates and legislative initiatives.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]\n<h2><strong>2. central points of the application<\/strong><\/h2>\n<h3><strong>2.1 Differentiation of Bitcoin in the MiCA context<\/strong><\/h3>\n[\/vc_column_text][vc_column_text css=&#8221;.vc_custom_1764924961541{margin-left: 50px !important;}&#8221;]\n<ul>\n<li>Bitcoin is described as a separate category within digital assets.<\/li>\n<li>The MiCA Regulation is understood to primarily address <strong>centralized issuers, custodians and platforms.<\/strong> <\/li>\n<li>Fully decentralized protocols such as Bitcoin should not be placed in the same regulatory framework as centrally controlled projects without necessity.<\/li>\n<\/ul>\n[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]\n<h3><strong>2.2 Regulation and infrastructure<\/strong><\/h3>\n<p>The application warns against treating the basic infrastructure of the Bitcoin network like traditional financial intermediaries, in particular:[\/vc_column_text][vc_column_text css=&#8221;.vc_custom_1764925028736{margin-left: 50px !important;}&#8221;]\n<ul>\n<li><strong>non-custodial wallets<\/strong>,<\/li>\n<li><strong>Lightning Nodes<\/strong> and other decentralized services,<\/li>\n<li>Infrastructure tools that do not manage third-party funds.<\/li>\n<\/ul>\n[\/vc_column_text][vc_column_text css=&#8221;&#8221;]The fear is that excessive regulation could drive <strong>open source development<\/strong>, innovation and start-ups in this area out of Germany.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]\n<h3><strong>2.3 Tax treatment<\/strong><\/h3>\n<p>The main requirements are:[\/vc_column_text][vc_column_text css=&#8221;.vc_custom_1764925098630{margin-left: 50px !important;}&#8221;]\n<ul>\n<li>the confirmation and clarification of the <strong>twelve-month holding period<\/strong> for privately held Bitcoin,<\/li>\n<li>a <strong>clear legal separation<\/strong> of Bitcoin and other crypto-assets,<\/li>\n<li>the avoidance of a blanket classification of small, private mining or lightning operations as a business.<\/li>\n<\/ul>\n[\/vc_column_text][vc_column_text css=&#8221;&#8221;]The aim is to increase <strong>legal certainty<\/strong> for citizens and investors.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]\n<h3><strong>2.4 Energy, location and digital sovereignty<\/strong><\/h3>\n<p>The application emphasizes:[\/vc_column_text][vc_column_text css=&#8221;.vc_custom_1764925286645{margin-left: 50px !important;}&#8221;]\n<ul>\n<li>the potential role of Bitcoin mining as a <strong>flexible load<\/strong> in the energy system,<\/li>\n<li>the use of <strong>surplus electricity<\/strong> and the integration of renewable energies,<\/li>\n<li>the importance of Bitcoin in international <strong>currency and location competition<\/strong>,<\/li>\n<li>and Bitcoin as an instrument for strengthening the <strong>digital and financial sovereignty<\/strong> of citizens.<\/li>\n<\/ul>\n[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]\n<h2><strong>3. what we welcome in terms of content<\/strong><\/h2>\n<p>From the perspective of the Bitcoin Bundesverband, there are several points that go in a direction that is compatible with our mission.<\/p>\n<h3><strong>3.1 Clear focus on Bitcoin<\/strong><\/h3>\n[\/vc_column_text][vc_column_text css=&#8221;.vc_custom_1764940310164{margin-left: 50px !important;}&#8221;]\n<ul>\n<li>The <strong>distinction between Bitcoin and a vague &#8220;crypto&#8221; term<\/strong> is key: We represent companies that work with Bitcoin, not the entire crypto market.<\/li>\n<li>The fact that Bitcoin is understood as an independent, decentralized infrastructure with special characteristics is a sensible basis for any further political discussion.<\/li>\n<\/ul>\n[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]\n<h3><strong>3.2 Protection of infrastructure and open source<\/strong><\/h3>\n[\/vc_column_text][vc_column_text css=&#8221;.vc_custom_1764940357482{margin-left: 50px !important;}&#8221;]\n<ul>\n<li>The requirement not to treat <strong>non-custodial wallets, lightning nodes and similar infrastructure<\/strong> as regulated financial intermediaries protects innovation and entrepreneurship.<\/li>\n<li>This perspective is crucial for the German location in order not to unnecessarily hinder <strong>development, research and open source projects<\/strong>.<\/li>\n<\/ul>\n[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]\n<h3><strong>3.3 Legal certainty for taxes<\/strong><\/h3>\n[\/vc_column_text][vc_column_text css=&#8221;.vc_custom_1764940395861{margin-left: 50px !important;}&#8221;]\n<ul>\n<li>The aim of creating <strong>legal certainty<\/strong> for privately held Bitcoin is understandable from our members&#8217; point of view: Unclear tax conditions make offers and investments more difficult.<\/li>\n<li>Predictable tax treatment is the basis for reputable providers and business models to emerge and remain in Germany in the long term.<\/li>\n<\/ul>\n[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]\n<h3><strong>3.4 Energy and industrial use<\/strong><\/h3>\n[\/vc_column_text][vc_column_text css=&#8221;.vc_custom_1764940424959{margin-left: 50px !important;}&#8221;]\n<ul>\n<li>The fact that Bitcoin mining is explicitly considered in the context of <strong>energy systems and industrial processes<\/strong> is an important step towards a more objective discussion.<\/li>\n<li>In our environment, models are already being discussed in which mining can contribute to the <strong>utilization of surplus energy<\/strong>, to <strong>grid stabilization<\/strong> or to increasing efficiency through the <strong>use of waste heat<\/strong>.<\/li>\n<li>The fact that such potential is now also being addressed in parliament supports a fact-based debate on Bitcoin and energy.<\/li>\n<\/ul>\n[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]\n<h2><strong>4. where we see a need for optimization<\/strong><\/h2>\n<p>In addition to these positive points, we also see aspects that could be worked out more precisely in the further parliamentary debate.<\/p>\n<h3><strong>4.1 A more differentiated view of sustainability and energy<\/strong><\/h3>\n[\/vc_column_text][vc_column_text css=&#8221;.vc_custom_1764940494968{margin-left: 50px !important;}&#8221;]\n<ul>\n<li>The energy argumentation remains partly generalized.<\/li>\n<li>For a sustainable political classification it is helpful:\n<ul>\n<li><strong>clearly defined key figures<\/strong> and scenarios,<\/li>\n<li>a separation between <strong>global developments<\/strong> and specific projects in Germany,<\/li>\n<li>a realistic assessment of when and where Bitcoin mining actually contributes to <strong>better use of energy<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n[\/vc_column_text][vc_column_text css=&#8221;&#8221;]We are happy to contribute our professional perspective here in order to deepen the content of the debate.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]\n<h3><strong>4.2 Involving companies and the real economy more closely<\/strong><\/h3>\n[\/vc_column_text][vc_column_text css=&#8221;.vc_custom_1764940544635{margin-left: 50px !important;}&#8221;]\n<ul>\n<li>The proposal focuses heavily on <strong>private investors<\/strong> and their tax treatment.<\/li>\n<li>In the view of the Bitcoin Bundesverband, it is worth focusing more strongly on future debates:\n<ul>\n<li>the role of Bitcoin in <strong>companies and SMEs<\/strong>,<\/li>\n<li><strong>practical use cases<\/strong> in the real economy (payments, micropayments, process heat, energy management),<\/li>\n<li>the requirements of companies that want to productively integrate Bitcoin into their value chain.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n[\/vc_column_text][vc_column_text css=&#8221;&#8221;]Here we can contribute concrete experience and examples from our member companies.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]\n<h3><strong>4.3 More differentiated debate on regulation<\/strong><\/h3>\n[\/vc_column_text][vc_column_text css=&#8221;.vc_custom_1764940592632{margin-left: 50px !important;}&#8221;]\n<ul>\n<li>The comparison of &#8220;regulation&#8221; vs. &#8220;freedom&#8221; falls short of the mark.<\/li>\n<li>From our point of view, it is helpful to make a clear distinction:\n<ul>\n<li><strong>where<\/strong> regulation is necessary (e.g. custody of client funds, intermediaries with a systemic role),<\/li>\n<li>and <strong>where<\/strong> restraint makes sense (e.g. infrastructure, self-custody, open source development).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n[\/vc_column_text][vc_column_text css=&#8221;&#8221;]We are not fundamentally opposed to regulation, but believe that a <strong>targeted, proportionate and risk-oriented<\/strong> approach is crucial. Such differentiation can noticeably increase the quality of further discussion.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]\n<h3><strong>4.4 Sharpening international classification<\/strong><\/h3>\n[\/vc_column_text][vc_column_text css=&#8221;.vc_custom_1764940637223{margin-left: 50px !important;}&#8221;]\n<ul>\n<li>The motion refers to geopolitical developments, but remains relatively general.<\/li>\n<li>This is important for Germany&#8217;s strategic position:\n<ul>\n<li>which <strong>international examples<\/strong> of regulation, energy integration and business use of Bitcoin can serve as a reference,<\/li>\n<li>and where Germany can set <strong>its own priorities<\/strong> instead of just reacting to developments.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n[\/vc_column_text][vc_column_text css=&#8221;&#8221;]Here, too, we are available to broaden your view of international best practices.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]\n<h2><strong>5. role of the Bitcoin Bundesverband in the further process<\/strong><\/h2>\n<p>Motion 21\/2301 will be discussed in further parliamentary proceedings, probably in the relevant specialist committees and in further debates in plenary.<\/p>\n<p>The Bitcoin Bundesverband will:[\/vc_column_text][vc_column_text css=&#8221;.vc_custom_1764940708689{margin-left: 50px !important;}&#8221;]\n<ul>\n<li><strong>closely monitor<\/strong> the parliamentary treatment of the motion,<\/li>\n<li><strong>evaluate<\/strong> the reactions and alternative proposals of other groups,<\/li>\n<li>contribute its technical expertise in order to <strong>advance the content of future debates<\/strong>,<\/li>\n<li>and concrete offers of discussion, in particular on the topics of\n<ul>\n<li>MiCA implementation,<\/li>\n<li>tax structure,<\/li>\n<li>Energy and location issues,<\/li>\n<li>Bitcoin in the real economy<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n[\/vc_column_text][vc_column_text css=&#8221;&#8221;]submit.<\/p>\n<p>We see ourselves as a <strong>non-partisan point of contact<\/strong> and make our expertise available to <strong>all democratic actors<\/strong>.
